Department of Health cites companies for water pollution violations on Oʻahu

The Hawaiʻi Department of Health (DOH) has taken enforcement action against ABC Towing & Parts, LLC and JH Hawaii Property, LLC for violations related to water pollution on Oʻahu. The DOH issued a Notice of Violation and Order (NOVO) due to polluted discharge into Waiawa Stream and operating without the necessary National Pollutant Discharge Elimination System (NPDES) permit at the ABC Towing & Parts facility in Pearl City.

The enforcement includes a $55,000 fine and mandates corrective measures such as applying for the required permit for stormwater discharge associated with industrial activities. Industrial facilities under NPDES regulation must secure permits before starting discharges to ensure fair competition among businesses that invest in environmental protection. Property owners are responsible for ensuring their tenants comply with these regulations.

Non-compliance with Hawaiʻi’s water pollution laws can result in fines up to $60,000 per day for each violation. These laws aim to safeguard public health and the environment by preventing harmful discharges into water bodies. The DOH Clean Water Branch (CWB) oversees these regulations, and violators may face additional legal actions from state or federal agencies or private individuals.
