Hawai'i amends rules on hemp processing allowing low THC in gummies

On November 26, 2024, Governor Josh Green approved changes to the Hawaiʻi Department of Health's (DOH) administrative rules concerning hemp processing and manufactured hemp products. The amendments to Chapter 11-37 (interim rules) now permit gummies and beverages to contain a low concentration of tetrahydrocannabinol derived from hemp. Additionally, permitted hemp processors can produce crude extract from hemp biomass. This extract is not for consumption but can be sold to other permitted processors for use in manufacturing hemp products.

Chapter 11-37 outlines the requirements for processing cannabinoid hemp and selling manufactured hemp products, aiming to protect public health and safety. These regulations apply to cannabinoid hemp processors handling biomass into crude extract or preparing manufactured products. The DOH does not regulate industrial hemp.

The updates are intended to support Hawaiʻi’s hemp farmers and industry by enhancing processing capabilities and expanding the variety of available consumer products while maintaining safety and quality standards.
