The Hawaiʻi Department of Health (DOH) has issued a Notice of Violation and Order (NOVO) to Maui Asphalt X-IV, LLC for multiple violations related to their National Pollutant Discharge Elimination System (NPDES) permit. These violations occurred at the company's asphalt batch plant in Waimea, Kauaʻi.
Maui Asphalt is required to pay $33,000 and undertake corrective measures to comply with their NPDES general permit coverage. The NOVO will become final 20 days after being served unless a hearing request is filed.
“NPDES permits ensure that all organizations are held accountable for the proper disposal of pollutants,” stated Kathleen Ho, deputy director for the Environmental Health Administration. “It is everyone’s responsibility to help keep our waters clean.”
All individuals and entities, including business owners and government agencies, must adhere to environmental laws aimed at protecting Hawaiʻi. Non-compliance with water pollution regulations can result in penalties up to $60,000 per day for each violation.
The DOH Clean Water Branch works to safeguard public health and the environment by preventing discharges that harm water quality. This ensures that Hawaiʻi's waters remain fishable and swimmable for all. Adherence to environmental regulations is essential for protecting both the public and Hawaiʻi’s delicate ecosystem. Violations may lead to legal actions by state or federal authorities or private citizens.
