DCCA announces disciplinary actions for April 2024 in Hawaii

The state Department of Commerce and Consumer Affairs (DCCA) along with its respective state Boards and Commissions have released a summary of disciplinary actions through the month of April 2024. These actions were taken against individuals and entities holding professional and vocational licenses in Hawai‘i. The disciplinary actions are based on either the results of contested case hearings or settlement agreements submitted by the parties.

Respondents enter into settlement agreements as a compromise to claims, aiming to conserve on the expenses of proceeding with an administrative hearing. The DCCA and the Boards and Commissions are tasked with ensuring those with professional and vocational licenses perform up to the standards prescribed by state law.

In one such case, Nicole Linton, a respondent under the Board of Nursing, had her license voluntarily revoked effective from April 4, 2024 (Case Number: RNS 2022-0854-L). This action was taken because she was disciplined by the state of Texas and failed to timely notify the Board of the disciplinary action, potentially violating HRS §§ 457-12(a)(8) and 457-12(a)(10). The Board approved this Settlement Agreement.

Under the Board of Pharmacy, Easy RX Pad LLC, doing business as Procure Pharmaceutical Services (Case Number: PHA 2023-50-L), was fined $2,500 effective from April 18, 2024. The Respondent was disciplined by the state of Missouri, potentially violating HRS § 436B-19(13). This Settlement Agreement was also approved by the Board.

Another respondent under the same board, Pillpack LLC operating as Pillpack by Amazon Pharmacy (Case Number: PHA 2023-38-L), was fined $500 effective from April 18, 2024. They were disciplined by the United States of America for potential violations of HRS §§ 436B-19(13) and 461-21(a)(5), and HAR § 16-95-110(a)(12). The Board approved this Settlement Agreement as well.
