U.S. Senator Mazie K. Hirono (D-HI), along with 12 other Senate Armed Services Committee members, has called on Secretary of Defense Pete Hegseth for explanations concerning the sudden dismissal of several Judge Advocate Generals (JAG). In a letter addressed to Secretary Hegseth, the lawmakers demanded legal justification and documentation regarding the decision-making process behind these dismissals. They expressed concern over statements made by Secretary Hegseth about these actions.
The senators stated that "by arbitrarily and baselessly removing duly selected and highly qualified JAG officers, the Administration undermines the military justice system and has interfered with the independent legal counsel that uniformed attorneys provide to commanders and the Department itself." They warned that such removals create a chilling effect, indicating positions may depend on political loyalty rather than legal expertise.
The JAG Corps is crucial in providing independent legal advice within the military, covering areas such as military justice, international law, operational law, administrative compliance, and ethics. The senators emphasized that these dismissals violate federal law and undermine military justice integrity.
The lawmakers also criticized Secretary Hegseth’s plan to demote JAG leadership from three-star generals to two-star officers. They argued this move could reduce oversight necessary for ensuring compliance with international law and potentially expose U.S. forces to war crimes allegations.
"The independence of military legal professionals must be preserved," concluded the senators. They insisted on rectifying any actions that erode this independence without delay.
Senators joining Hirono in signing the letter include Jack Reed (D-RI), Jeanne Shaheen (D-NH), Kirsten Gillibrand (D-NY), Richard Blumenthal (D-CT), Tim Kaine (D-VA), Angus King (I-ME), Elizabeth Warren (D-MA), Gary Peters (D-MI), Tammy Duckworth (D-IL), Jacky Rosen (D-NV), Mark Kelly (D-AZ), and Elissa Slotkin (D-MI).
